The Act is primarily intended to facilitate building works. It is designed to ensure that the person who wishes to carry out the works (the Building Owner) can do so.
However it places a mandatory requirement on the Building Owner to inform any neighbours (by issuing a Notice) of the details of the works to be undertaken prior to the works starting on site.

The Act provides various benefits and safeguards for the neighbour (the Adjoining Owner) to ensure that their property is adequately safeguarded during the construction works by the appointment of Party Wall Surveyors.

Once appointed, the surveyors (or one jointly agreed surveyor) will draw up an Award which details methods of construction, restrictions on noisy works and most importantly of all, the clear identification of any damage caused during the course of the works.

The Act is designed to avoid disputes between neighbours by ensuring that all matters of contention are agreed and that a formal agreement is in place prior to the works starting.
